What the Rental Act requires

Chapter XIV of the Rental Act (no. 36/1994) sets out how a rental property is inspected. Igloo covers each step.

  • Art. 69

An inspection at the start and end of the lease

The landlord and tenant inspect the property, including fire safety, when the contract is made and when the lease ends.

With Igloo: Igloo handles both the move-in and the move-out report. Fire safety is recorded in the rental contract itself.

  • Art. 69

An independent inspector if either of you asks

If either party asks, an independent inspector they agree on carries out the inspection, and the cost is split equally unless they agree otherwise.

With Igloo: Add the inspector to the report, and they sign it with you.

  • Art. 71

A detailed description of the property

When an independent inspector carries out the inspection, their inspection statement describes the property and its condition in as much detail as possible, and names its amenities, the contract date and the parties.

With Igloo: Go through each space, the furniture and appliances, meters and keys, and add photos as you go.

  • Art. 72

    Signed by everyone

An inspector's statement is signed by both parties and the inspector, and each keeps a copy. The inspection is the basis if there is a dispute about damage when the property is returned.

With Igloo: Everyone signs electronically, and we send the report to HMS.

Why do inspections matter?

An inspection protects both the landlord and the tenant by recording the condition of the property clearly at move-in and move-out.

When you agree on the condition from the start, there is less room for misunderstanding, deposit claims rest on facts, and both of you are treated fairly.

Common questions about inspections

Is an inspection of a rental property mandatory?

Yes. Under article 69 of the Rental Act, the landlord and tenant inspect the condition of the property, including fire safety, when the contract is made and when the lease ends. The findings of the move-in inspection are recorded in the rental contract.

Can the inspection be done online?

Yes. In Igloo you do the inspection together in the app or on the web, everyone signs electronically, and we send the report to HMS.

Who pays for an independent inspector?

If either party asks for an independent inspector at the start or end of the lease, the landlord and tenant split the cost equally. If an inspection is requested at any other time, whoever asks for it pays. In both cases you are free to agree on a different split.

What if the landlord and tenant disagree?

The signed inspection is the basis if there is a dispute about the tenant's liability for damage when the property is returned. A dispute about the inspection itself can be referred to the Housing Complaints Committee.
